We Aren’t Paid Unless You Collect

We have all seen the television lawyer ads for Alabama workers compensation or Social Security Disability cases.  The lawyer appears on T.V. and tells the viewing audience that at their firm-there is no charge for their services in a workers comp or disability claim unless you win.  The impression they want to make is that they are willing to forgo being paid unless they obtain compensation for their clients, but the truth is they don’t have a choice.

By law, an attorney who represents an injured worker in an Alabama Job Injury claim, or someone seeking Social Security Disability or SSI benefits, cannot charge a fee by law unless they recover (by settlement or verdict) in favor of their client.

By law, a lawyer can charge no more than 15% of the total monetary recovery-plus reimbursement for reasonably fees and expenses.  MOREOVER, the fee and expenses being requested by the attorney have to be authorized by either a Judge in an appropriate venue or an Ombudman with the Alabama Department of Labor before the attorney can be paid.

The same is when it comes to how attorneys who handle Social Security Disability claims are paid.  By law, an attorney who is representing a disabled client is allowed to charge up to 25% of the backpay they help their client receive-or $6,000.00-whichever is less, unless that case has to be appealed to Federal Court; in this circumstance, while an attorney’s fee is still limited to 25% of his client’s backpay-the $6,000.00 limitation is not in place.
