Medical Treatment under Alabama Workers’ Comp Law

If you work in Alabama and have suffered an injury at work, you are most likely entitled to benefits under Alabama’s Workers’ Comp Law.  Part of your rights under our Worker’ Compensation Law includes your medical treatment.

While you are free to see whomever you wish to treat you for an on the job injury, your personnel health insurance will likely not pay for said treatment if it was work related, meaning that for all practical purposes you have to see the physicians chosen by your employer’s workers’ compensation insurance carrier; but, per Alabama’s Workers’ Compensation Law, your employer’s workers’ compensation insurance carrier is responsible for paying all your “reasonably necessary medical and surgical treatment and attention, physical rehabilitation, medicine, medical and surgical supplies, crutches, artificial members and other apparatus….”

While Alabama’s Workers’ Compensation Law is unambiguous about this fact, far too often the workers’ compensation insurance carrier will attempt to evade their responsibility by having some doctor in another state review some of your records and opine that the treatment recommended for you is not reasonably necessary.  While we cannot see what tomorrow may bring, the experienced Alabama Work Injury attorneys at Powell and Denny have, to date, never lost an argument before the court when this occurs.  The fact remains that if the recommended treatment was not “reasonably necessary,” it is doubtful that your treating physician would have recommended the treatment, and the court gives greater weight to the opinion of the treating physician, as opposed to some doctor of unknown qualifications who is paid for an opinion.
