While it is true that according to Ala.Code §25-5-78, an injured workers is supposed to provide written notice of a workplace injury within 5 days of the on-the-job injury, but this section goes on to state that, in Alabama, a worker has up to 90 days in which to inform his employer about a job injury. Having stated this, please try to ensure that the incident is WRITTEN UP in a report–it’s amazing how bad the supervisor’s at Wal-Mart’s memory can be as to whether they can remember if you told them about suffering a job injury.
Once you have provided notice of you job injury, your workers’ compensation claim should be opened. In Alabama, in valid workers’ compensation claims, an employer (through their workers’ compensation insurance carrier) must pay for (a) all of the workers’ reasonably necessary medical treatment, (b) reimburse the worker for mileage in driving back and forth for medical treatment or to receive medications; (c) pay the worker 2/3rds of their average weekly wage when off work pursuant to the advice of a physician treating them for their job injuries (until the date they reach maximum medical improvement) and (d) pay compensation to the injured worker for any permanent physical impairment sustained as a result of an on-the-job injury.
