Higher Risks of Work Injury for those working in Retail

Higher Risks of Work Injury for those working in Retail

The Holidays are upon us, and everyone is trying to do more and more in the same 24 hours allotted us. Nowhere is this more evident than with retail workers in America-with extended hours, sales and delivery service-as the attached article details.

Did you know that according to the Bureau of Labor Statistics, 3.5 of every 100-retail worker suffered a work-related illness or injury last year? This puts retail workers at a higher risk for work injury that workers in the manufacturing sector. Those working in home furnishings (think Lowe’s, Home Depot and similar stores) and employees of Pet Stores are those retail workers most at risk statistically.

Moreover, if you work for Walmart and you suffer a serious work-related injury, I can honestly say that you need an experienced Alabama Workers Compensation Lawyer.
I do not say this lightly; generally, when an injured worker calls our office to discuss whether they should hire an attorney, I tell them that technically you do not have to hire an attorney, although it may very well be in your best interest to do so. With Wal-Mart, I believe an experienced work injury attorney is vital. Why? Because Wal-Mart is hyper aggressively in fighting all workers’ compensation claims. Be it a claim based on carpel tunnel syndrome, a torn ACL, a herniated disk or some other injury, Wal-Mart routinely claims that the injury complained of was not the result of the injured worker’s job duties. I cannot recall the last time a claim for workers’ compensation benefits settled against Walmart without a lawsuit first having to be filed, depositions taken and doctors’ records gone over with a fine toothed comb. A lot of times it takes a court order to force them to pay for the recommended surgery or treatment.

Over the last 27 years, our lawyers have represented numerous workers who were injured while working for a retail store. Many suffered back injuries (herniated discs) or shoulder problems (torn rotator cuffs) due to the heavier nature of their jobs and the repeated nature of their activities. Honestly, I think the number of retail workers who actually suffer job related injuries is higher than 3.5%-but most workers who suffer a work injury do not seek workers’ compensation benefits in hopes that their employer will look favorably on them for sacrificing their legal rights; unfortunately this rarely happens (businesses are only interested in profits).

If you work in a retail store and you suffered a job injury and have questions about your right to Alabama Workers Compensation benefits, don’t hesitate to call and speak with one of the experienced Alabama Workers Compensation Lawyers at Powell and Denny today.
