Delivery Drivers, Job Injuries and Employee Status

Delivery Drivers, Job Injuries and Employee Status

Delivery drivers do have a job which places them in more peril than the vast majority of jobs. They are driving most of the time-often at night or in bad weather, going places where they have no idea who is on the other side of the door–all for little pay.

Too often these days companies who hire delivery drivers try to claim that they are not really “employees,” they are “contract labor.” Bull crap-this is just an excuse to try and avoid tax liability and ensuring their employees are covered for job related injuries through the company workers’ compensation carrier.

In Alabama, an employee is defined as follows: “Employee or Worker-the terms are used interchangeably, have the same meaning throughout this chapter, and shall be construed to mean the same. The terms include the plural and all ages and both sexes. The terms include every person in the service of another under any contract of hire, express or implied, oral or written, including aliens and also including minors who are legally permitted to work under the laws of this state….”

Pretty simple-if you are regularly employed to work for a company, and said company directs you in what you do and when you do it-you are their employee, at least in terms of Alabama workers’ compensation law.

If you have suffered a job injury and you have questions about your rights to Alabama workers’ compensation benefits, don’t hesitate to contact and talk with one of the experienced Alabama Workers’ Compensation Attorneys at Powell and Denny today.
