You don’t pay unless we win

Like many Alabamians, whenever my wife and I are watching the news, I see a slew of ads on tv from law firms here in Alabama that talk about how they won’t take a fee unless they recover for their clients in a work injury claim or a claim for Social Security Disability benefits.  To those who do not know how attorneys are paid in an Alabama workers compensation claim, or how federal law dictates how a lawyer who represent clients in a claim for Social Security Disability benefits (SSDI or SSI) are paid, this probably sounds like a great deal-but it really isn’t.  These TV firms are just following the law-they just make is sound as though they are doing something special.

By law, an attorney who represents an injured worker in an Alabama Workers’ Compensation claim can charge no more than 15% of the total monetary recovery (via settlement or by verdict after trial and appeal), plus reimbursement for reasonably fees and expenses.  MOREOVER, the fee and expenses being requested by the attorney have to be authorized by either a Judge in an appropriate venue or an Ombudsman with the Alabama Department of Workforce (formerly the Department of Labor).  I have heard from clients who used to be represented by other firms that their previous attorney had their temporary total disability (ttd) checks sent to the lawyer’s office and that the lawyer would take a fee of 15% out of the ttd checks.  This is inappropriate.

If an attorney represents an injured worker in an Alabama workers’ compensation claim-they CANNOT receive compensation for their work until your case is resolved.  That’s the law.

This is true when it comes to how lawyers who handle Social Security Disability claims are paid.  By law, an attorney who is representing a disabled client is allowed to charge up to 25% of the backpay they help their client receive-or $9,200.00-whichever is less, unless that case has to be appealed to Federal Court; in this circumstance, while an attorney’s fee is still limited to 25% of his client’s backpay-the $9,200.00 limitation is not in place.
