Workers Compensation and Working at Home

We have previously written blogs on what a person needs to show in order to have a valid workers’ compensation claim in Alabama, but to summarize that blog, a worker has to be able to show that (1) they were the employee of the defendant, (2) that their employer had 5 or more employees regularly employed, (3) that the injured worker (i) suffered an injury at work (ii) while performing their job duties, (4) that notice of their job injury was reported to their employer within 90 days and that (5) the injured worker must be able to prove that the injury they are complaining from was the result of their job accident.

You will notice that a necessary factor is not that the work injury occurred on the premises of where the injured worker is employed.  Quite often a work-related injury doesn’t occur on the business premises.  For instance, most construction workers spend the majority of their work day somewhere other than the main office, those employed in sales are in and out of the office and truck drivers work all over the country.  The same is true when a person suffers a job injury while working from home.

Given the current pandemic, thousands of workers are doing the majority of their job duties from their home for safety reasons, and I believe that many will continue to do so once we have gotten through the crisis caused by the coronavirus (and we will get through it).  Given this fact, there has been an increase in work related injuries that have occurred while one is doing their job at their own house.

The fact you were in your own house does not mean that you don’t have a workers’ compensation claim.  If you suffered an injury while performing your job duties, you are just as entitled to Alabama workers compensation benefits as a person who was injured in the middle of the warehouse.  What matters is whether you were engaged in work activity at the time of your injury.
