Alabama Job Injury Lawyer What Are My Rights when I like my doctor but comp tells me that I have to see another doctor? Just as there will be cases where the injured worker does not believe the company doctor has their best interest at heart, there are also many cases where the injured worker likes their treating doctor, but workers comp doesn’t like what they are doing, so comp tries to force the injured worker to see another doctor (called an independent medical examination or IME). What are your rights when this happens?
If you are happy with the authorized treating physician workers’ compensation has sent you to for treatment, then you are under no obligation to see attend an independent medical examination scheduled by the workers’ compensation adjuster and we strongly recommend that you do not see the IME doctor, as the comp carrier is most likely only trying to create some uncertainty in your case so they can use it to their advantage. Make no mistake, the workers compensation insurance carrier is not wanting you to see another doctor because they believe it is in your best interest. If litigation takes place, then the judge over you case may order an independent medical examination, but the judge would pick the physician you see-no the workers comp carrier.
