My Workers’ Compensation Claim Was Denied — What Do I Do Next?

If your claim for workers’ compensation benefits has been denied, the most important thing to know is this: a denial is not the end of your case. Many valid Alabama workers’ compensation claims are denied initially, often for reasons that do not hold up under the law.

One of the most common reasons given for denial is that the insurance carrier claims the injury was not caused by work, but instead resulted from a preexisting condition. This argument is frequently raised in cases involving back, neck, shoulder, or joint injuries. However, Alabama law is clear: workers’ compensation benefits are not reserved for employees in perfect health. If an employee was able to perform job duties before the accident and a work-related incident aggravates, accelerates, or makes symptomatic a preexisting condition, the injury is generally compensable.

Another frequent reason for denial is skepticism rather than evidence. Injured workers are sometimes told their claim is denied because there were no witnesses, the employer does not “believe” the injury occurred as described, or the injury was reported later rather than immediately. These are not legal grounds, by themselves, to deny a claim. Many legitimate workplace injuries occur without witnesses, and delayed reporting does not automatically defeat a claim—especially when the injury was not immediately apparent.

In some cases, claims are denied simply because liability is disputed and the insurance carrier chooses to force the issue. Denial can be a strategic decision, shifting the burden onto the injured worker to pursue the claim formally. While this can be frustrating, it does not mean the claim lacks merit.

When a workers’ compensation claim is denied, the next step is typically to file a claim with the appropriate court and present evidence supporting compensability. This may include medical records, testimony regarding job duties, proof of work capability before the injury, and documentation showing timely notice. Judges—not insurance adjusters—ultimately decide whether a claim is compensable under Alabama law.

What often makes the difference in denied cases is persistence and proper presentation of the facts. Many injured workers successfully obtain benefits after an initial denial, but it rarely happens by simply accepting the carrier’s decision.
