Alabama Workers Compensation Questions: (19) Is it true that comp will pay my medical bills for life?
YES. Alabama’s Workers’ Compensation law states that your employer’s workers compensation insurance carrier is responsible for paying for all reasonable and necessary medical treatment related to a work injury for the rest of your life. Should you settle your case, or try it and the court rules in your favor, workers’ comp will have to continue paying for your reasonable and necessary medical treatment. You will still need to see the authorized treating physician, so you are not free to see whomever you wish, but as long as the treatment is still related to your on the job injury, workers comp will have to pay for your treatment, including future surgeries, therapy and medication.
If you have another accident which worsens your condition, then your right to future medical treatment will most likely be terminated.
You do have the option of asking the court to approve a settlement of your right to future medical treatment, in which for money you waive any right to further treatment through workers’ compensation. This is not something to be done without serious thought, as your are never sure what the future may bring and your personal health insurance carrier or Medicare/Medicaid may refuse to pay for treatment which should have been covered under a workers’ compensation claim.
