Alabama Workers Compensation Problem I Can’t get my Medication

“Workers’ Comp won’t get me the medication the treating physician prescribed me.”  Unfortunately, this is one of the biggest complaints we hear from injured workers.   The workers compensation insurance carrier will not authorize the medication I need; and in my experience, this occurs quite often when you need pain medication.

I really have not heard a good excuse as to why the medication prescribed by the authorized treating physician is not automatically authorized, because I don’t believe there is a good excuse.  A glich in the computer system is not a good excuse, and does not explain why-after being informed of said glich-the injured worker still cannot get their medicine.  I have had some adjusters and defense lawyers argue that want to have another doctor look and see if the prescribed mediation is “reasonably necessary,” because they are worried for the injured worker-but I think this is bunk.  They don’t want to pay for the medicine and for this reason they are willing to spend hundreds of dollars trying to convince you or the court that you really don’t need the medicine the doctor prescribed.

If your medication is being denied or refused, you can do something about it.  A lawyer experience in handling workers compensation claims can take the matter before a judge and ask the court to order the defendant to pay for your medication, or to pay for any reasonably necessary medical treatment the insurance carrier refuses to pay.
