Alabama Workers Compensation Attorneys. I have been practicing workers’ compensation, wrongful termination and Social Security Disability law in Alabama for nearly 34-years, and it is quite normal for a client whose case seems to be dragging on and on to complain that they “just want it over with.” I spoke with such a client earlier today, and while the injured worker always has the final say in their case, when I hear this from a client I try to calm them down and focus on what the most important part of their case is—recovering a fully as possible from a job injury.

We completely understand. Years of living off of temporary total disability benefits is difficult, and having to endure multiple surgeries can be excruciating. Wanting it all to just go away is wrap up the claim can be desirable, but just settling the case so you can be done with dealing with workers compensation is probably a bad idea. Our number one focus-both ours and our clients’-has to be getting them as healed as possible, and that means keeping pushing forward with reasonable medical care as long as the surgeon thinks they can help you, we should see if they can. This is not to say an injured worker has to agree to any surgery recommended. Alabama law is clear-if refusing to undergo surgery is “reasonable” (we are not talking about surgery for an ACL tear, or carpel tunnel-but spinal surgery, fusions, etc.), then the injured worker does not have to acquiesce and have the surgery, but they are expected to take all reasonable steps to try and receive all the medical care they need.
The injured worker is generally in a state of some depression and exhaustion; our job is to clarify what is of the utmost importance, and that is thinking about their condition 5-years from now if they do not keep in the right. That is one of the biggest reason an experienced Alabama work injury attorney can be beneficial-the ability to listen to their clients, try and respond to their worries and concerns, and try to remind them that the quickest route is not always the best.
