NO FEE UNLESS YOU WIN

NO FEE UNLESS YOU WIN

Like most Alabamians, the other day I was watching the news when I was hit with a barrage of T.V. lawyer adds, and I was struck by the new ads coming out that talk about how “this” law firm doesn’t take a fee unless they win for their clients; they make it sound like they are doing something honorable and going above and beyond their obligations-when in fact they are just doing what the law says attorneys who practice in the fields of Alabama workers compensation or Social Security Disability are legally obligated to do.

By law, an attorney who represents an injured worker in an Alabama Workers’ Compensation claim can charge no more than 15% of the total monetary recovery (via settlement or by verdict after trial and appeal), plus reimbursement for reasonably fees and expenses.  MOREOVER, the fee and expenses being requested by the attorney have to be authorized by either a Judge in an appropriate venue or an Ombudman with the Alabama Department of Labor.

If an attorney represents an injured worker-they CANNOT receive compensation for their work until your case is resolved.  That’s the law.

This is true when it comes to how lawyers who handle Social Security Disability claims are paid.  By law, an attorney who is representing a disabled client is allowed to charge up to 25% of the backpay they help their client receive-or $6,000.00-whichever is less, unless that case has to be appealed to Federal Court; in this circumstance, while an attorney’s fee is still limited to 25% of his client’s backpay-the $6,000.00 limitation is not in place.

At Powell and Denny, our attorneys have over 30 years individually (60 years combined) in handling Alabama job injury claims and claims for Social Security Disability benefits.  When we talk with potential clients, we explain the law and how we are paid for our services.  We have published blogs on the question of how an attorney is paid in an Alabama Workers Comp claim or in a disability claim because we want to give people as much information as we can so they can make an educated decision in what law firm to hire.  We don’t try to mislead people seeking legal assistance.

If you hire one of the lawyers at Powell and Denny to represent you or a family member in a claim for Alabama workers compensation benefits, or for Social Security Disability benefits, there is no fee unless you recover.  It’s the law.

If you have questions about your right to Alabama Workers’ Compensation benefits, or Social Security Disability or SSI benefits, don’t hesitate to contact and speak with one of the experienced attorneys at Powell and Denny today to schedule an in-person appointment, or to schedule a virtual appointment via Zoom for your convenience.
