Alabama Workers Comp: What is The CAP?

Alabama Job Injury Attorney The CAP: Most workers who have suffered a job injury have no idea that the amount of compensation you can receive for an injury is capped by law.

In Alabama, once an injured worker has reached maximum medical improvement (mmi), the amount of monetary compensation the injured worker can receive for injuries which are not permanently disabling is capped; that is to say limited by statute.  The injured workers cannot receive more than $220.00 a week for their injury; the number of weeks of benefits they are entitled to depends on their injury.

For instance, if a worker in Alabama loses both of their arms below the shoulder, the law states that they are entitled to receive $220 a week for 400 weeks.  This totals $88,000.  If a worker loses one leg, they are entitled to $220 a week for 200 weeks for a total of $44,000.

The idea that workers seek workers compensation benefits to live the good life is ridiculous.

Alabama’s workers compensation law needs to be amended to help protect the workers of Alabama, and Powell and Denny and other firms throughout Alabama are pushing Legislators to do the right thing.  Workers’ Compensation insurance premiums in Alabama are less than most of the States, and the number of reported injuries which led to an injured worker missing time from work is down 5%.  Companies are doing better; it is time to help out workers as well.
