I was trying to relax the other evening with my wife watching the television, when yet another lawyer commercial came on which I have been seeing a lot of lately, and this one did get under my skin.

One firm out of Florida who loves to talk about their size are running a series of commercials in Alabama (at least in the Birmingham market), where they talk about how injured workers’ aren’t nobodies to them and about how quick they are to call back an injured worker who suffered an Alabama work injury when they leave a message about their workers’ compensation claim.  Sounds wonderful, but is it true?

I don’t generally write about other law firms directly in blogs because it can seem to be nothing more than sour grapes-but the reason these workers’ comp commercials got my attention is because two weeks earlier they had someone come to my office to talk to me about referring them personal injury cases.  While here, I told them that our firm has a focus on Alabama workers’ compensation claims and on Social Security Disability claims.  At this point I asked the woman from said firm if they handled Alabama workers’ compensation claims.  “Oh no, we don’t handle workers comp claims.  If you refer one to us, we would just have to send it out to someone else.”  The same is true with Social Security Disability claims per the law firm’s representative.

I asked the representative whether they felt disingenuous about running commercials saying they and their team would be there for injured workers, or those seeking Social Security Disability benefits, that they would fight for them- as they don’t actually handle these cases—they refer them out to other lawyers for a promise in return to send them good personal injury cases.  I told her this upset me as at Powell and Denny, injured workers and disabled persons are who we represent, and have for over 30 years.

Injured workers in Alabama may not be a nobody to this “big” firm, but they aren’t their clients either.
