In Alabama, the answer is yes—but not for seeking workers’ compensation benefits.
Employment in Alabama is generally “at will,” meaning an employer may terminate an employee for many reasons, such as misconduct, policy violations, intoxication at work, or economic layoffs. The fact that you suffered a workplace injury does not, by itself, guarantee continued employment.
However, Alabama law draws a firm line at retaliation. An employer cannot legally terminate an employee solely because the employee reported a job injury or pursued workers’ compensation benefits. When that happens, the employee may have a claim for retaliatory discharge (wrongful termination).
Alabama courts look at several key factors when evaluating a retaliatory discharge claim:
Evidence that other injured employees were treated similarly may also support a finding of retaliation.
These cases can be difficult to prove. Employers rarely admit that a termination was related to a workers’ compensation claim, and direct written evidence is uncommon. As a result, wrongful termination claims are often established through circumstantial evidence, inconsistencies in the employer’s stated reasons, and comparison to how other employees were treated.
Despite these challenges, Alabama law does provide protection. Workers should not have to choose between their health and their livelihood. Reporting a legitimate workplace injury and seeking the medical care and benefits provided by law is a protected activity.
