Workers Comp Adjuster pressuring you to settle?

Here at Powell and Denny, our attorneys (Greg Denny and William Powell) have both handled workers’ compensation cases for over 31 years, and it has not been uncommon for an injured worker to call our office after repeatedly being pressured by the adjuster handling their workers comp claim to settle their claims.  The injured workers generally do not know what kind of value their claim has, so understandably they want to find out if the deal they are being offered is fair.

Typically, when we discuss the claim with the injured worker, we go over what their injuries were, how many weeks of ttd benefits they received, what permanent physical impairment they have sustained as a result of their job injury, and whether the offer includes closing their right to pursue any wrongful termination claim or their right to future medical care for their work related injury.  You might be surprised to learn that most of the injured workers we speak with really do not know the answer to any of these questions. You see, the adjuster is not obliged to explain what an injured worker is entitled to receive under Alabama’s workers’ compensation laws, and their duty or loyalty does not lie with the injured worker.  As a result, the less explained to the injured worker-the better for the insurance carrier.

I know a defense attorney who told me about a settlement he did on behalf of his client-the workers’ compensation insurance carrier.  He explained how dirty he felt getting the settlement taken care of as the injured worker had a herniated disc which needed surgery, but the adjuster had convinced the injured worker that their claim was not a good one and the injured worker settled out all aspects of their claim for $5,000.  The injured worker needed surgery.  They would require physical therapy after surgery to try and help the recover, but they did not receive any of this.  The case settled, the injured worker forfeited their right to medical care and was unable to work—all for $5,000.00.  They trusted that the adjuster was taking care of them, so they did not bother to discuss their claim with an experienced Alabama workers compensation attorney-and this was a critical mistake which will affect them for the rests of their life.

If an adjuster is pushing you to settle your claim, if they are telling you that you really don’t have a good case-you should stop and think.  Who is the adjuster concerned with taking care of?  Once you realize that the adjuster is not worried about your well being, you should contact a lawyer with experience handling Alabama workers’ compensation cases to find out what your rights.  The workers compensation insurance provider has lawyers protecting their interests—shouldn’t you have one who is looking our for yours?
