Questions to Ask before Hiring an Alabama Workers’ Compensation Lawyer

If you live or work in Alabama, and you have sustained a workers’ compensation injury, most likely you have a lot of questions.  Do I have a claim?  Can I see my own doctor?  How do I get paid if I am off work due to my injuries?  This is where an experienced Alabama Workers’ Compensation Lawyer can be invaluable, but before taking the step to actually hire an Alabama Workers’ Compensation Attorney, there are several questions you ask any potential lawyer you are considering.  This is the first of a series of seven (7) blogs in which I will go through the questions I believe an injured should ask of a lawyer before actually hiring an attorney.

First, is the person you are speaking with actually an attorney?  Believe it or not, a lot of injured workers in Alabama hire an attorney to represent them without actually speaking with the lawyer they end up hiring.  I have known attorneys who work for firms that advertise on television tell me that they often walk into the office with several new files on their desk representing new clients that their firm has hired over night when a call was taken by the call center.  The injured worker hired their firm after a brief conversation with the call center and never actually spoke with an attorney.

Legal assistants are valuable to an attorney, but they are not lawyers, and they do not have the knowledge and experience to go through Alabama’s workers’ compensation laws in detail with you and answer your questions.  If an attorney is too busy to take the time to speak with you and answer your questions, they probably won’t have to time to speak with you during the pendency of your case.  Handling workers’ compensation claims in Alabama is more of an art than a science, and in my experience, you cannot adequately represent an injured worker without the personal touch.  As a lawyer, I need my clients to talk to me and inform me about what is going on with their medical treatment and how things are going at work; what are their concerns, and I like getting my information directly from my clients and not second hand.

You should not hire a lawyer based on a commercial or a conversation with an assistant who is not licensed to practice law in Alabama.  Make sure you actually talk to a lawyer.
