Questions to Ask before Hiring an Alabama Workers’ Compensation Lawyer

Questions to Ask before Hiring an Alabama Workers’ Compensation Lawyer

If you live or work in Alabama, and you have sustained a workers’ compensation injury, most likely you have a lot of questions.  Do I have a claim?  Can I see my own doctor?  How do I get paid if I am off work due to my injuries?  This is where an experienced Alabama Workers’ Compensation Lawyer can be invaluable, but before taking the step to actually hire an Alabama Workers’ Compensation Attorney, there are several questions you ask any potential lawyer you are considering.  This is the fifth of a series of seven (7) blogs in which I will go through the questions I believe an injured should ask of a lawyer before actually hiring an attorney, and it relates to the questions we suggested you ask regarding the potential attorney’s experience.

Question Five, ask about the lawyer about the Pros and Cons of your case.  You may think your claim for Alabama Workers’ Compensation benefits is pretty cut and dry, but an experienced workers’ compensation attorney knows that pitfalls exist in every case.  Can your injury be related to a preexisting condition?  The workers compensation insurance adjuster is going to try and make that argument.  Did you test positive for drugs or alcohol in your post-accident drug screen?  Was proper notice of your injury provided?  The number of issues that could present themselves during your claim are numerous, and the more experience the attorney has, the better prepared they will be to handle these issues should they arise.

If the lawyer you are talking to can’t foresee any potential problems which might arise during the pendency of your claim, it may be due to a lack of real experience.  At Powell and Denny, we try to be upfront with our client about the possible defenses which could be used against our clients.  We want to discuss these issues so our clients are not caught by surprise when the issues arise, and we want to go through these potential pitfalls so we can know best how to proceed with developing the case.  Worst case scenarios rarely occur-but that doesn’t mean that your lawyer shouldn’t prepare for the worst should it happen.

If you live anywhere in Alabama and you have questions about your right to Alabama Workers’ Compensation benefits, don’t hesitate to contact and speak with one of the experienced attorneys at Powell and Denny today to schedule a virtual appointment or a face-to-face meeting.
