Questions to Ask before Hiring an Alabama Workers’ Compensation Lawyer

If you live or work in Alabama, and you have sustained a workers’ compensation injury, most likely you have a lot of questions.  Do I have a claim?  Can I see my own doctor?  How do I get paid if I am off work due to my injuries?  This is where an experienced Alabama Workers’ Compensation Lawyer can be invaluable, but before taking the step to actually hire an Alabama Workers’ Compensation Attorney, there are several questions you ask any potential lawyer you are considering.  This is the second of a series of seven (7) blogs in which I will go through the questions I believe an injured should ask of a lawyer before actually hiring an attorney.

Second, ask what level of experience the attorney you are talking to has in handling workers’ compensation claims in Alabama.  How long have they been practicing law in Alabama?  What percentage of their cases have been Alabama workers’ compensation cases?  Workers’ comp cases are not like general tort law cases.  In an automobile accident case, if someone ran a red light and hit you, then they are liable.  Things are not so cut and dry with a workers’ compensation claim and an attorney needs to have the experience in handling comp claims in Alabama to know where the potential pitfalls lie.

Experience is invaluable.  When my car stopped running a few months ago, I knew that I needed to have my car looked at by someone experienced at working on a car like mine. I didn’t want to have someone who just did auto mechanics as a hobby part time, I wanted someone who knew what they were doing. Similarly, if you have been hurt at work, you would want to speak with an attorney whose practice emphasizes workers compensation claims, not a firm which handles a few now and then along with slip and fall, dog bite or general negligence cases.

You wouldn’t let a podiatrist operate on your back just because they call themselves “doctor.”.  Don’t let a firm that spends most of their time pursuing automobile accident cases see if they can also handle a workers’ comp case.
