If the Work Accident was My Fault — Can I Still File a Workers’ Compensation Claim?

It is not uncommon for injured workers to hesitate about pursuing a workers’ compensation claim because they believe the accident was their fault. Many people feel uncomfortable seeking benefits when they made a mistake or believe they should “take responsibility” for what happened.

That reaction is understandable—but under Alabama law, fault is generally not the issue.

Alabama’s workers’ compensation system is a no-fault system. This means that, in most cases, it does not matter whether the injury was caused by a momentary lapse in judgment, a simple mistake, or an unavoidable accident. If you were injured while performing your job duties, workers’ compensation is usually the only legal avenue available to obtain medical treatment and compensation for any lasting injury.  If a job injury is caused by being under the influence, “goofing off” or ignoring safety protocols-then the injured worker would be estopped from receiving workers compensation benefits, but not just because they made a mistake.

If an injured worker chooses not to pursue workers’ compensation benefits, the alternatives are often unrealistic or risky. Private health insurance is generally not obligated to pay for work-related injuries. Attempting to shift a work injury to private insurance can result in denied claims, repayment demands, or uncovered medical bills. Serious injuries often involve costs—such as surgery, physical therapy, or long-term care—that most people cannot afford out of pocket.

Workers’ compensation exists to provide medical care and limited wage replacement so injured workers can recover and, when possible, return to work. The Alabama Legislature created the system to ensure that workers are not left without treatment simply because an accident occurred on the job—even when the accident was caused by the worker’s own actions.

The system also protects employers. In exchange for providing workers’ compensation benefits, employers are generally shielded from negligence lawsuits. Injured workers generally cannot typically sue their employer for pain and suffering or punitive damages. This balance allows businesses to manage risk while ensuring injured employees receive necessary care.

Filing a workers’ compensation claim after a workplace accident—regardless of fault—is not taking advantage of the system. It is using the system exactly as it was intended to be used.
