In the next “From the Files of Powell and Denny,” I am going to briefly go over the facts from one of our Central Alabama workers compensation trials in St. Clair County, Alabama.

Our client was a younger individual who suffered a serious shock at his worksite.  Initially our client complained of pain in his joints, dizziness and had headaches.  He was sent to see the company physician-who really did not do much to treat his symptoms, so our client requested a panel of four and chose a new treating physician, but when things got too confusing for him-that’s when he decided to hire our firm.

A neurologist took over the medical care for our client, but unfortunately our client had suffered permanent nerve damage—but as a result of the severe shock, he also suffered permanent psychological injuries.  We were able to force the workers’ compensation insurance company to send our client to a psychiatrist for and evaluation and treatment, and during his deposition the psychiatrist testified that our client was currently incapable of keeping a job.  Nevertheless, the defense attorneys did not believe that our client was entitled to total disability benefits, and a week before trial they informed us that $60,000.00 was all they would pay to settle our client’s claim.

Seems the defense attorneys did not think much of our case because: (1) they did not believe psychological injuries can be serious, (2) our client was in their early 30’s and (3) St. Clair County is pretty conservative.  What they hadn’t counted on is that (i) through hours of prep-our client did an outstanding job testifying at trial and (ii) Judge Seay knows the law.

We were able to obtain a permanent total disability verdict for our client.  Our client received over $140,000.00 after trial, and they have received over $300,000 in ptd benefits thus far. We were also able to help our client be awarded Social Security disability benefits.
