Do you know who your Lawyer works for?

The ads are all over tv, law firms (not all of which are actually located in Alabama) advertising that they represent injured workers in their Alabama workers’ compensation claim, or those seeking Social Security Disability benefits (SSDI and SSI).  These firms spend upwards to a million dollars in television ads actively seeking injured and disabled workers to contact them so they can represent them.  How would you feel-after hiring one of these firms-that the attorney handling your case is not even employed by the television firm?

This may sound strange because what firm would pay hundreds of thousands of dollars in advertisement for workers comp cases and Social Security Disability claims if they don’t actually handle them?  Well, one firm that loves to talk about their size on TV actually farms out their Alabama workers’ compensation and Social Security Disability claims out to other attorneys who handle Alabama job injury claims, and in return these referring attorneys refer them serious personal injury claims.  If you are hiring a firm because their commercials talk about their size and you are persuaded to hire them because of this, then shouldn’t you at least actually be represented by the large TV firm and not by someone at another firm with whom they have a referral agreement?

Some other firms who advertise for these types of claims have attorneys who are basically independent contractors.  They get the cases from the television firm and work on their behalf, but they are not employees of the firm.  If you see the phrase “of counsel,” you should ask whether the lawyer with your case is actually employed by the tv firm.

If you are asked to sign a Fee Agreement with the television firm and you see in the contract a phrase like “and associates,” you should ask if your attorney is an employee of this law firm, and not merely someone who associates with the firm.
