Do I Need a Lawyer for a Social Security Disability Claim Based on Stiff Person Syndrome?

Do I Need a Lawyer for a Social Security Disability Claim Based on Stiff Person Syndrome?

If you or a loved one has been diagnosed with Stiff Person Syndrome (SPS) and are considering applying for Social Security Disability benefits, you are likely dealing with a condition that is both rare and debilitating.

A common question we hear is: “Do I need a lawyer for this type of disability claim?”  Isn’t the diagnoses enough?

The short answer is: You are not required to hire a lawyer—but in complex cases like Stiff Person Syndrome, experienced legal guidance can be extremely helpful.

What Is Stiff Person Syndrome?

The first time I ever heard of Stiff Person Syndrome (SPS), it was while watching the evening news and a story was on about Celine Dion and her recent diagnosis with Stiff Person Syndrome.  Since that time, we have had clients hire us to represent them in their claim for SSDI and/or SSI benefits related to the medical finding that they suffer with this terrible disease.

Stiff Person Syndrome is a rare neurological disorder that affects the central nervous system, and it is characterized by:

  • muscle stiffness and rigidity
  • painful muscle spasms
  • difficulty with balance and walking
  • sensitivity to noise, touch, or emotional stress

Over time, these symptoms can significantly interfere with a person’s ability to:

  • stand or walk for extended periods
  • perform routine physical tasks
  • maintain consistent employment

Because SPS is rare, many people—including decision-makers reviewing disability claims—may not be familiar with how severe and limiting the condition can be.  In fact, many physicians are not totally sure about the disease as well.  Powell and Denny represented a claimant in their claim for Social Security disability benefits who had been misdiagnosed as suffering from fibromyalgia for years before they were finally diagnosed as suffering from Stiff Person Syndrome.

Can You Get Disability Benefits for Stiff Person Syndrome?

Yes—but approval is not automatic.  Social Security will evaluate your claim based on:

  • the severity of your symptoms
  • how your condition affects your ability to function
  • whether you can perform work on a regular and sustained basis

Because Stiff Person Syndrome is not specifically listed in the Social Security “Listing of Impairments,” claims are often evaluated based on:

  • neurological limitations
  • muscle control and mobility
  • your Residual Functional Capacity (RFC)

Why These Claims Can Be Challenging

Stiff Person Syndrome cases can be more difficult than more common conditions because:

  • it is a rare diagnosis
  • symptoms can vary significantly from person to person
  • medical records may not clearly describe functional limitations
  • decision-makers may not fully understand the condition

In many cases, the issue is not whether the diagnosis exists—but whether the impact of the condition is fully documented.  To be approved for disability benefits, you must show more than a diagnosis.

Social Security will look for evidence showing:

  • how your symptoms limit your ability to stand, walk, or sit
  • how often spasms or stiffness interfere with daily activities
  • whether you can safely perform work tasks
  • whether your condition prevents consistent, full-time work

How Powell and Denny Can Help

An attorney experienced in Social Security Disability claims can assist by:

  • helping ensure your medical records clearly describe your limitations
  • obtaining opinions from your treating physicians
  • preparing you for hearings before an Administrative Law Judge
  • explaining how your condition affects your ability to work in legal terms

In cases involving rare conditions like Stiff Person Syndrome, properly presenting the functional impact of the condition can be critical.

Stiff Person Syndrome is a serious and often disabling condition—but approval for Social Security Disability benefits depends on how well your limitations are documented and presented.

Because these cases can be complex, especially given the rarity of the condition, it may be helpful to speak with someone familiar with how Social Security evaluates disability claims.  If you or a loved one has been diagnosed with Stiff Person Syndrome and are considering applying for Social Security Disability benefits—or if your claim has been denied—it may be helpful to discuss your situation with an experienced attorney.
