Can I get disability benefits for mesothelioma? Mesothelioma is an aggressive, deadly and rare cancer that occurs in the thin layer of tissue that covers the majority of your internal organs. Treatments are available, but for many people, a cure is not possible.

Doctors divide mesothelioma into different types based on what part of the mesothelium is affected. Most common is the form which often affects the tissue that surrounds the lungs (pleura). This type is called pleural malignant mesothelioma. Other, rarer types of forms affect tissue in the abdomen (peritoneal mesothelioma), around the heart and around the testicles.

The symptoms vary from person to person. Common symptoms of pleural mesothelioma include shortness of breath, chest pain and a chronic dry cough. Symptoms of peritoneal mesothelioma include swelling of the abdomen, abdominal pain and fluid in the abdomen.

The Code of Federal Regulations lists several conditions and the required symptomology that must be present in order for someone to meet disability standards. The medical requirements for mesothelioma can be found at Listing 13.15. If you do not “meet or equal” this listing, you may still be entitled to disability benefits if your condition, in conjunction with any other physical or mental impairment, prevents you from returning to work you have done in the past and other substantial work you might be qualified to perform given your age, education and acquired work skills.
