Can I get disability benefits for HIV? HIV (human immunodeficiency virus) is a virus which weakens the body’s immune system to the point that a suffer has difficulty fighting off certain infections.  AIDS is a chronic, potentially life threatening condition caused by HIV.  It can take years before your immune system is weakened to the point where you are diagnosed as having AIDS (acquired immunodeficiency syndrome).  Fortunately, much has been done in the last few years to enable those suffering from this disease to live in more comfort and to maintain a fulfilling life, but the disease still can be devastating-both physically and emotionally.

The Social Security Administration lists human immunodeficiency virus as a condition which can be disabling when the symptoms interferes with the persons ability to engage in sustained work activity.  Listing 14.07 in the Code of Federal Regulations lays out in specifics the impairments which a sufferer has to have in order to qualify for Social Security Disability Benefits, but some of the list includes: candidiasis, carcinoma of the cervix, herpes simplex, histoplasmosis, HIV wasting syndrome, Hodgkin’s disease, pneumocystis carinii pneumonia and pulmonary tuberculosis which is resistant to treatment.

If you do not “meet or equal” this listing, you may still be entitled to disability benefits if your condition, in conjunction with any other physical or mental impairment, prevents you from returning to work you have done in the past and other substantial work you might be qualified to perform given your age, education and acquired work skills.
