Can Artificial Intelligence Replace an Experienced Attorney?

Twice this year I had to withdraw from representing clients—one in a Social Security Disability case and one in an Alabama workers’ compensation claim—because they believed that after getting on Chat GPT, CoPilot, Open AI or some other form of AI-they knew best how to proceed with their claim and they were demanding we take actions that simply were not reasonable under the law or the facts, and this is a growing concern.  As I explained to my former clients, there is only room for 1 attorney representing them, and while the decision on how to proceed is theirs, we cannot ethically take orders from AI on how to proceed in a case.

Artificial intelligence is a tool. It can try to help explain legal concepts and summarize information, but it is not a licensed attorney. It is not accountable to a court. And it does not exercise legal judgment.

One of the most serious problems with AI in the legal field is what has been termed “hallucinations”—fabricated case citations, incorrect statutes, or misstatements of the law. Attorneys across the country have already been sanctioned for filing briefs that relied on AI-generated cases that did not even exist. Judges have made it clear: lawyers are responsible for what they file. There is no “the computer told me so” defense.  Additionally, AI can be more of a cheerleader tool, hypothesizing on what best could happen, but not referencing the down side of specific actions.

Workers’ compensation and Social Security Disability cases are not just formula-driven. They require:

  • Strategic presentation of medical evidence
  • Knowledge of how local judges and vocational experts operate
  • Understanding settlement structure and long-term consequences
  • Sound judgment about what arguments help—and what arguments hurt

AI cannot evaluate credibility.
AI cannot cross-examine a witness.
AI cannot anticipate how a particular judge will view a case.
AI cannot ethically stand behind the advice it gives.

As attorneys, we are bound by professional rules. We are licensed and legally accountable for our actions. We have an obligation to refuse to pursue strategies that are unsupported by the law or harmful to a client’s case—even if a client insists.

Artificial intelligence can be a helpful research tool when used carefully, but it cannot replace experience, professional responsibility, or courtroom experience.
