Distracted Driving: In 2012, Alabama became the 37th State to pass a law banning texting while driving.  To date, 46 States, the District of Columbia, Puerto Rico, Guam and the U.S. Virgin Islands have similar laws, reflecting the concern and damage caused by distracted driving.

According to the National Highway Traffic Safety Administration (NHTSA), distracted driving is defined by anything that diverts a driver’s attention from safely operating their motor vehicle and include: visual distraction (something which takes a driver’s eyes off the road and traffic), cognitive distraction (something which takes the driver’s attention away from driving their car) and manual distraction (something which occupies a driver’s hands while they should be on the wheel of their vehicle).  Texting on a cell phone/smart phone involves all three categories of distracted driving and is especially dangerous because of this fact.

Two reports from the Governor’s Highway Safety Association concluded that between 15 to 30 percent of all crashes are caused in part by distracted driving.  This would equate to 4,000 injuries and 125 fatalities during the timeframe they looked at.

Texting is not the only thing which causes distraction to drivers.  Switching radio stations, eating, personal grooming and other things can also cause a driver’s attention to be diverted from the serious business of operating a motor.  During the 2015 Legislative Session, a bill to expand Alabama’s Distracted Driving law to include other types of distraction was defeated but did draw attention to other types of distractions people face every day while driving their automobiles.

If you were injured in a motor vehicle accident, you already have a lot to deal with and it is easy to put off worrying about what steps to take to ensure you and your family are compensated for everything you will be forced to endure due to the negligence of a distracted driver, but failing to ensure the appropriate steps have been taken to ensure all the relevant facts have been nailed down can lead to legal difficulties.  The fact is that the more time that passes after an automobile accident, the fuzzier memories of witnesses gets and the harder it can be to tie medical care to the injuries sustained in the car wreck.

You don’t have to deal with this alone.

If you have been injured in an automobile accident and you have questions about your rights under Alabama law, don’t hesitate to contact and speak with one of the experienced Alabama Car Wreck attorneys at Powell and Denny today for a free consultation.  Appointments are available in person, or virtually through Zoom for your convenience.
