Huntsville Workers Compensation Lawyers: Can I use my own Insurance? What are my Rights? It is common for an injured worker to call us and ask if they can use their own health insurance to see the doctor after suffering a work injury. Many times the injured workers’ boss has asked them to just put everything on their health insurance. This way, you get the treatment you want from whom you want and your employer won’t have to report any job injury.  Regardless of how tempting this may seem, do not do this.

First off, Alabama law dictates that your employer has to report a job injury. This is not open for interpretation.

Secondly, if you lie (and you would have to lie about how the accident occurred in order for your health insurance to pay for your treatment) about how you were injured, you are committing fraud. Your actions would be forcing your insurance carrier to bear a cost they are not legally obligated to pay.

Thirdly, if your insurance provider later finds out that your injury was really the result of a job accident, they will withdraw all the monies they have already paid for your treatment, and you will be personally responsible for paying these medical bills. Most of us simply do not have the money to pay for any extensive medical treatment out of pocket.

Lastly, despite your employer’s promises to “take care of you,” once you lie to a physician about how your injury occurred, it is extremely tempting (and easy) for your employer to “forget” that you were hurt at work. At this point, all they have to say is that you never told them that you were hurt at work, and it can be extremely hard for you to prove otherwise.

While we have successfully assisted injured workers collect the workers compensation benefits they were entitled to in this situation, it is difficult and there is no guarantee that you will be able to convince the court of the validity of your case if you lied to your doctor and insurance carrier about how the injury occurred. You are basically telling the court that you lied several times about your injury, but that the court should believe you now. This is not a position you ever want to be in.
