Do You Know Who Your Lawyer Is?

I literally could not count the number of times I have been at the Office for Hearing Operations with a client, waiting to go before the judge for my client’s day in court in their Social Security Disability claim, that I have witnessed a lawyer come in and say out loud a person’s name in a questioning manner and wait for someone to answer. When the person does, the attorney goes over, introduces themselves and tells them that they are their lawyer and will be representing them on one of the most important days in their lives.

At this point my client generally states something to the effect that they would hate to have someone they have never met or spoke with show up and ask them questions about their case minutes before they have to go in front of a judge. I have to agree.

If you have not met with your lawyer before your hearing, that means that they have not taken the time to sit down and prepare you for your hearing. They haven’t asked if there are other medical records that they need to have in order to adequately represent you in your claim for disability benefits. If they don’t know you-what makes you think they know about how your illness and/or injuries affect your ability to hold down a full-time job? Why would you think they have a strong legal argument explaining to the court why you should be awarded disability benefits if they don’t know you?

I am not saying that these lawyers are not well versed in Social Security law or that they are not experienced, but after spending over 27 years practicing Social Security Law I can attest that there is nothing better in helping you or your lawyer prepare your claim than meeting with you several times before your hearing. Additionally, you really do need to meet with your lawyer and try to get to know them somewhat- not only for the betterment of your case, but for your own peace of mind.
