Alabama Disability Attorney: HIV

Alabama Disability Attorney: HIV

As the author in the attached article points out, “[w]hile the south makes up 38% of the U.S. population, about 45% of people who are HIV positive live in the South.”

HIV (human immunodeficiency virus) is a virus which weakens the body’s immune system to the point that a suffer has difficulty fighting off certain infections. AIDS is a chronic, potentially life-threatening condition caused by HIV. It can take years before your immune system is weakened to the point where you are diagnosed as having AIDS. Fortunately, much has been done in the last few years to enable those suffering from this disease to live in more comfort and to maintain a fulfilling life, but the disease still can be devastating-both physically and emotionally.

The Social Security Administration lists human immunodeficiency virus as a condition which can be disabling when the symptoms interfere with the person’s ability to engage in sustained work activity. Listing 14.08 in the Code of Federal Regulations lays out in specifics the impairments which a sufferer has to have in order to qualify for Social Security Disability Benefits , but some of the list includes: candidiasis, carcinoma of the cervix, herpes simplex, histoplasmosis, HIV wasting syndrome, Hodgkin’s disease, pneumocystis carinii pneumonia and pulmonary tuberculosis which is resistant to treatment.

Suffers whose condition causes them to have a “marked limitation” in their ability to engage in daily activities, maintain social functioning of causes difficulties in completing tasks in a timely manner due to deficiencies in concentration, persistence or pace may also qualify for disability benefits.

If you or a loved one lives in Alabama, you are suffering from human immunodeficiency virus or AIDS and you believe you are disabled as the result and are entitled to Social Security Disability or SSI benefits, you do not have to tackle the Social Security Administration alone.
