The VA says I’m Disabled-so why was my claim denied
Alabama Disability Attorney-The VA says I’m disabled, isn’t that enough? We have dealt with this question, or something similar, many times. Those who suffered a disability associated with their service to the country generally first apply for VA disability benefits before applying for Social Security Disability Benefits. After receiving a 60-100% VA disability rating, they understandably believe that obtaining Social Security disability benefits would be something easily obtained, but this is rarely the case.
The reason is that the Veteran’s Administration uses a different set of criteria that the Social Security Administration. With Social Security, a 5 step set of criteria is used (looking to see if you can do your past relevant work given your condition(s), and if not, if other jobs exist which you would be able to perform given your condition(s), age, education and work skills). Having stated this, a high VA Disability rating will definitely help prove your disability, but standing alone it is rarely sufficient.
If you live in Alabama and you have been denied disability benefits but believe that you are disabled-or if you just have questions about your right to SSI benefits, contact and speak with one of the experienced Alabama Social Security Disability lawyers at Powell and Denny for a free consultation.
