Am I eligible for Social Security Disability Benefits? Social Security Disability Benefits (SSDI) are those benefits available for persons who have-through work and payment of their Social Security taxes, have earned a sufficient number of credits and who are legally disabled.
In order to be entitled to Social Security Disability benefits in Alabama, you must meet the Social Security Administration’s definition of being disabled. In making this determination, the Social Security Administration follows a five-step sequential evaluation process in order; if the Administration determines that you are not disabled at the end of the first step, their evaluation will continue to the next step of the evaluation process until it has been determined that you are either disabled or not.
First, the Administration will look to see if you are currently working; if so, they look to see how much you are earning. Currently you cannot make more than $1100 a month before taxes to be eligible for SSDI benefits. If you get past the first step, then in step two the Administration will look at whether you have an impairment which is “severe.” If so, then the third step taken is to determine if you condition(s) meet or equal one of the Listing of Impairments listed in the Code of Federal Regulations. Most applicants for disability benefits do not meet this standard, but if you do, then you are automatically entitled to Social Security Disability benefits.
If you do not meet or equal a listing, then at step four the Administration looks to see if your condition(s) would prohibit you from performing your past relevant work (generally work performed in the last 15 years). If you condition does prevent past relevant work, then the Administration goes to step five, in which they determine whether you have the ability to perform other work on a sustained basis.
