Social Security Disability Hearing Process

Social Security Disability Hearing Process

If your initial claim and request for reconsideration of Social Security Disability (SSD/SSDI) benefits was denied, understandably you likely feel discouraged. Unfortunately, the Social Security Administration denies about 70 percent of initial claims for disability benefits.

For more than 45 years, Powell & Denny, P.C., in Birmingham and Huntsville, has advocated for individuals in similar situations. We are prepared to represent you in a hearing before an administrative law judge. This is a prime opportunity to present your story and your need for Social Security Disability benefits. Contact our Alabama law firm today to schedule a free initial consultation.

Presenting Critical Evidence Before an Administrative Judge

At Powell & Denny, P.C., our law firm’s experienced lawyers have helped hundreds of individuals pursue Social Security Disability benefits. We have a clear understanding of the right steps to take to seek justice.

If your request for a reconsideration of benefits was denied, we will pursue a hearing before a Social Security administrative judge within 60 days. This is our first chance to meet face-to-face with a real person and explain why your disability has prevented you from returning to work.

We will present invaluable evidence from your doctor, documenting the extent of your disability. Our law firm includes skilled legal advocates, prepared to stress the right points for a judge to fully comprehend the limitations of your disability. We want the judge to see you as a hardworking individual prevented from working as a result of your medical condition.

How Long Does the Appeal Process Take?

After your claim for Social Security Disability benefits is initially denied, expect a hearing about 12 to 18 months later. At Powell & Denny, P.C., we understand the financial and emotional strain that can build up during this time. We are committed to alleviating any extra stress through keeping you informed of the appeals process.

During this time, the attorneys at our law firm will consult your doctor so we have the most current evidence at the time of your hearing. We will also determine if you qualify for Supplemental Security Income (SSI) or damages under Alabama’s workers’ compensation system.

Birmingham Social Security Hearing Site

Birmingham Social Security Hearing Site.

Below is the information for the site where Social Security Hearing scheduled to take place in Birmingham, Alabama will be held.

1200 Rev. Abraham Woods, Jr. Blvd; 1st Floor, Birmingham, AL 866-613-2863

Birmingham, Florence, Montgomery and Mobile are cities where the Social Security’s Office of Disability Adjudication and Review (field offices that handle claims for Social Security Disability Benefits after they have been appealed) for the state of Alabama are located. If you or someone you care for has applied for disability benefits and you live in the areas surrounding Albertville, Bessemer, Birmingham Downtown, Birmingham East, Gadsden, Anniston, Jasper, Talladega or Tuscaloosa, then your claim — upon appeal — will be sent to Birmingham and handled out of the Birmingham Office of Disability Adjudication and Review.

Just because your claim is being handled out of the Birmingham Office of Disability Adjudication and Review does not mean that Birmingham will be the site of your hearing. Generally Social Security will schedule your hearing site within 75 miles of your home; however, your hearing may be farther away to enable the Social Security Administration to hold more hearings in one location. If travel arrangements are a problem for you, then contact your attorney or Social Security’s Office of Disability Adjudication and Review.

The Social Security Administration holds hearings and has office sites all across the state. The hearings are not always held in the same building, so it is a good idea to research this before you go to your hearing. We have done numerous hearings at these hearing sites over the years and parking is not usually too much of a problem.

You can find other information in our past Social Security Saturday and Sunday post.
