ABCs of Social Security Disability

Social Security Disability has a unique set of laws, with different rules and procedures from general tort law.  As such, Social Security Disability law has developed its own linguistics and phraseology that can be confusing to lawyers who do not emphasize Social Security Disability claims in their practice-more so for disabled workers.  In this blog, we will define general terms you will come across which defines the skills required to perform past jobs you may have performed and what type of job you may be able to perform with your medical problems.

Unskilled Work

Unskilled work is work which requires little or no judgment to do simple duties, duties which can be learned on the job in a short period of time.  An example would be loading trucks or removing pieces from a machine.  A person can usually learn these types of jobs in 30 days or less.

Semi-skilled Work

Semi-skilled work is work which needs some skills, but does not require doing the more complex work duties.  Semi-skilled jobs may require alertness and close attention to watching machine processes; or inspecting, testing or otherwise looking for irregularities; or tending or guarding equipment, property, materials, or persons against loss, damage or injury.  A job may be classified as semi-skilled where coordination and dexterity are necessary, as when hands or feet must be moved quickly to do repetitive tasks.

 Skilled Work

Skilled work is work which requires a fairly high level of complexity.  Types of work that require using judgment to determine the machine and manual operations in order to obtain the right quantity and quality of item produced.  This type of work can include reading of blue prints, precise measurements, determining what is needed, making computations, dealing with people, abstract ideas, or dealing with figures.

 

How your past relevant work is defined is of great importance in a claim for disability benefits.  An attorney knowledgeable with the Social Security Rules and Regulations should be equipped to help advise you on how your particular job history would be defined and as how this qualification-taken together with your current physical limitations- effect your ability to obtain disability benefits.
