Alabama Job Injury Attorneys: Told it was a coincidence:  Recently I had a telephone conversation with an injured worker who, at the direction of the workers compensation adjuster, had seen Dr. Jeffrey Todd Smith for a back injury they suffered at work.  He had suffered his back injury while lifting material at work, had provided notice of said injury, had been seen by the initial treating physician and was referred to see Dr. Smith after an MRI revealed a herniated disc.  He was irate because he was informed that his disc injury was old and that it was just “a coincidence” that he had experienced pain while lifting a box and that his injury therefore would not be covered under workers compensation, but that he would be glad to treat him under his personal health insurance.

The worker was understandably skeptical of such a diagnosis.  Most disk injuries do not readily tell when the disc was injured, so how a doctor was able to reach this opinion based on an MRI is not clear; but regardless, even if the doctor was correct, it doesn’t matter in workers compensation claims as, in Alabama, if you have a preexisting condition which does not affect your ability to perform your job duties and something at work aggravates this pre-existing problem-workers comp is responsible for your medical treatment.
