Huntsville Workers Compensation Lawyers: How do I file a claim? What are My Rights? If you were hurt on the job and suffered a job injury, you are most likely entitled to workers comp benefits; however, you will never receive any workers comp benefits if you do not first file a claim.

The first step to filing a claim for workers comp benefits in Alabama is to inform your employer of the fact you did suffer a work injury; this can be done by informing your supervisor of this fact, H.R. department or other company officials whom you have been informed should be told of any job injury. It is important to be sure to tell your employer that you have suffered a job injury and that you want medical treatment. Job injuries open the door to the worker receiving workers comp benefits, a job accident in which an injury did not result does not entitle the worker to any benefits, so simply telling your boss that you were involved in a job accident will not start the ball moving on your Alabama workers comp claim.

You have 90 days from the occurrence of the job injury to provide notice to your employer, but it is always the best policy to inform your employer immediately if you believe you have suffered a job injury.

Once you have informed your employer that you have suffered a job injury and desire medical treatment, your employer has an obligation to inform the Alabama Department of Labor of the fact one of their employees has suffered a job injury and they are to file a First Report of Injury with the State and file a claim with their workers comp insurance provider.
