Alabama Workers Compensation: Recently the National Economic & Social Rights Initiative (NESRI) issued a report describing national trends which have been eroding the benefits injured workers receive under the various States. Unfortunately, the report is not much different from the one released last year by NPR/ProPublica.

According to this policy brief, various States were systematically dismantling their workers' compensation laws because the State Legislatures "see workers comp as an unnecessary cost for business rather than a critical health care and social insurance program." This main attacks being made against workers' compensation laws by NESRI are as follows:

•· Excluding different health problems from coverage under workers compensation;

•· Increasing the legal red tape and making it more difficult for workers to receive workers compensation benefits;

•· Fixing the number of weeks an injured worker may receive compensation for a work injury regardless of how serious the job injury is;

•· Giving employers and their workers compensation insurance carriers more ability to control the medical care an injured worker receives-not the treating doctor;

•· Reducing the amount an attorney can charge to represent an injured worker-making it more difficult for an injured worker to find a good lawyer to represent them and

•· Allowing larger corporations to opt out of workers compensation coverage for their employees all together.

Last year in a story, in discussing the destruction of workers compensation laws taking place across America, the Washington Post stated: "Somebody ends up paying for those injuries...taxpayers. When a worker ends up unable to work because of an injury, he or she can be covered by Social Security Disability Insurance, a program that has steadily increased in cost over the past two decades. The rise has many demographic factors behind it, but it looks like the abdication of responsibility by employers may have played a role as well."

Alabama ranks at the bottom when it comes to the benefits injured workers receive, and this is wrong. It is past time for our citizens to let our Legislature know that injured workers deserve better.
