Alabama Workmans Compensation Lawyer. As I have stated in past blogs, most of my mornings at the office begin with a hot cup of coffee while reviewing various news stories and published reports concerning workers' compensation claims throughout the United States. The other day I read a story from Iowa about a worker who had suffered a traumatic brain injury while performing his job duties.

The injured worker had been awarded permanent total disability benefits 9 years earlier, but the workers compensation insurance carrier wanted to stop paying the injured worker the workers' compensation benefits they had been awarded, so they sent the disabled worker to a physical rehab doctor they paid to see him. Not surprisingly, this physical rehab doctor reported that the injured worker was no longer disabled, so the workers compensation insurance carrier stopped his check. At a hearing, the judge did not accept the report of the doctor workers' comp paid to say the injured worker was no longer disabled as: (i) the doctor did not give an opinion on all of the problems the worker was suffering from and (ii) the doctor was not qualified to give an opinion as to how a traumatic brain injury can affect someone. The workers' compensation insurance carrier took the matter all the way to the Iowa Supreme Court, where fortunately the Court upheld the opinion of the trial court.

Similar things happen in Alabama every day. An injured worker is told that they need surgery, the workers compensation insurance carrier requests an utilization review to enable them to have grounds for denying the surgery, or the insurance carrier tries to trick the injured worker into seeing another doctor so they can have someone saying the needed treatment really is not required. You have to remember that insurance companies make incredible amounts of money by NOT paying money to injured workers. The less in medical benefits they pay out, the more they keep.
