Alabama Job Injury Attorney The real face of fraud: Recently we published a blog which showed that in the vast majority of workers compensation claims (like 98%) are valid claims (click here for the post). People do not forgo their regular wages in order to collect 2/3rds of their wages while having to pay 100% of their bills-it just doesn't make sense.

Obviously some fraud amount unscrupulous workers does occur, but the real fraud that occurs in workers compensation claims is-in my opinion-probably committed by employers. No, they are not colluding with their employees and asking them to lie and claim workers compensation benefits, but they do misrepresent the number of workers they have and their payrolls in order to obtain workers compensation benefits at a lower premium. One way this is done (besides flat out lying to the insurance carrier) is to represent their employees as "independent contractors."

Earlier this year several articles appeared in the press discussing how the Federal and several States (Alabama included) and cracking down on businesses classifying workers as "independent contractors." These employers are trying to circumvent payroll taxes and workers compensation premiums by insisting that their workers are really self-employed despite the fact they work 40+ hours a week for them.

Regardless of how an employer choses to classify a worker, in Alabama a person will generally be deemed your employee for workers' compensation purposes if the employer directs them in what and when they perform their job duties. Whether you receive a 1099 or W-2 is not dispositive.
