In Alabama, if you suffered a compensable work injury and are in need of medical treatment, you are free to see whomever you wish, BUT while you are free to see whomever you wish to see for an injury, you should realize that your personnel health insurance will not pay for treatment related to a work injury. There are plenty of cases where the comp carrier has tried to state that they get to determine: what specialist you get to see, what tests you get to have performed, what pharmacy and injured worker has to use, even where any tests are to be performed. In each case, our appellate courts have stated that the comp carrier's control does not extend this far. According to Alabama law, the workers comp carrier must pay for any and all reasonably necessary medical treatment-end of story.

Unfortunately, the fact the law is clear on this matter does not mean that your workers comp insurance carrier will not still try to fight to prevent an injured worker from receiving the medical treatment they need in order to recover and return to work and thereby provide for their family.
