Huntsville Workers Comp Lawyer Who Controls My Medical Treatment

Huntsville Workers Comp Lawyer Who Controls My Medical Treatment? In Alabama, if you suffered a compensable work injury and are in need of medical treatment, you are free to see whomever you wish, BUT while you are free to see whomever you wish to see for an injury, you should realize that your personnel health insurance will not pay for treatment related to a work injury. This means that any treatment you receive by seeing who you want to see-instead of who comp tells you to see-will have to be paid for out of your pocket. Most of us simply cannot afford much medical care on a cash basis-which means that for most practicable purposes, yes, you do have to see the doctor workers compensation tells you to see following a job injury. HOWEVER, this does not mean that the workers compensation insurance company can control every aspect of your medical care or even decide every doctor who provides you medical treatment.

As we just stated, following a job injury the workers comp insurance carrier can tell you who your initial authorized treating physician is, but their control over the physician who provides you with medical treatment ends there, because if the doctor the workers comp carrier sent you to see determines that you need to see a specialist, then whomever the authorized doctor sends you to automatically becomes your treating physician-as long as the referral is reasonably necessary given you condition.

You see, despite what you may have heard, the workers comp carrier does not have total control over your medical care. There are plenty of cases where the comp carrier has tried to state that they get to determine: what specialist you get to see, what tests you get to have performed, what pharmacy and injured worker has to use, even where any tests are to be performed. In each case, our appellate courts have stated that the comp carrier's control does not extend this far. According to Alabama law, the workers comp carrier must pay for any and all reasonably necessary medical treatment-end of story.

Unfortunately, the fact the law is clear on this matter does not mean that your workers comp insurance carrier will not still try to fight to prevent an injured worker from receiving the medical treatment they need in order to recover and return to work and thereby provide for their family. If you find yourself in this position and your recommended medical treatment has been denied, don't give up!

If you were hurt at work and you are being denied medical treatment, don't hesitate to contact and speak with one of the experienced Huntsville Alabama Workers Compensation Lawyers at Powell and Denny today.
