Birmingham Workers Comp Lawyer: In March of this year, there was a lot of buzz after the NPR and ProPublica reports regarding the pitiful state of injured workers throughout America due to States continually chipping away at the benefits codified in their various State Statutes; done in a desperate bid to woo businesses to locate in their State by trading off the health and well-being of their workers (click here for one of our blogs on these stories). Unfortunately, Alabama was reported as having the worst workers compensation benefits for our injured workers, and it appears as though another Legislative Session will come and go without any action being taken to rectify this situation.

If the facts so widely reported by NPR and ProPublica were just discovered, one could understand that there was not enough time for meaningful legislation to be proposed and voted on, but this just isn't the case.

The other day I found a 2009 study conducted by the Government Accountability Office; the G.A.O. is the auditing arm of Congress. This study also discussed how most workers compensation claims are not actually paid by the workers compensation insurance carriers.

The most telling quote from this study was as follows:

"The accountability office said that 53 percent of health practitioners had reported experiencing pressure from company officials to play down injuries or illnesses...."

Over half of the doctors workers the workers compensation insurance carriers make injured worker see for treatment of their job injuries admit that they are pressured by workers comp to say that the injured worker is not hurt as badly as they actually are; I would suggest the figure is actually higher. Outrageous!

They fact is that politicians, workers compensation insurance carriers and businesses have known for years that the deck was stacked against injured workers, but they just don't seem to care. The workers compensation system was set up so that lawyers would only be needed to help a worker who suffered a catastrophic injury and might not be able to return to their old job, or to any other type of employment; but, today in Alabama workers have to fight just to have a MRI performed, or to help them find a doctor who will actually do what is best for THEM and not the workers compensation insurance carrier.
