Alabama Workers' Comp Lawyer Fraud: Did anyone else read about North Carolina Governor McCrory's ridiculous claim that 40% of workers' comp claims are fraudulent or abusive? Did the Governor cite any facts to support his assertion--of course not; facts would get in the way.

A few months ago we posted a research article which showed only 1-2% of all workers' compensation claims were false.

Quite honestly, more fraud and abuse occurs at the hands of the workers compensation carrier than the injured worker--if you know anyone who suffered a serious job injury, you know the ridiculous steps the workers compensation insurance will go through in an attempt to avoid their legal obligation.

Workers' compensation's purpose was to quickly ensure that the injured worker received the necessary medical care-in a quick manner-so that the worker could recover and return to work as soon as possible. Unfortunately, today the workers' compensation insurance carrier views their role as trying to ensure the injured worker receives the least amount of medical treatment-at the cheapest price. The well-being of the injured worker and their family is not a consideration. This is why hearing made up fairy tales of wide spread abuse of workers compensation by the injured employees irks me so much--these assertions are mostly lies told in order to deceive citizens into supporting more and more pro insurance based laws being passed to the detriment of the American worker.

Earlier this year several articles appeared in the press discussing how the Federal and several States (Alabama included) and cracking down on businesses classifying workers as "independent contractors." The Federal and State governments are realizing that this is being done in an attempt to avoid paying payroll taxes and workers' compensation premiums. This is FRAUD.

Regardless of how an employer choses to classify a worker, in Alabama a person will generally be deemed your employee for workers' compensation purposes if the employer directs them in what and when you perform your job duties. Whether you receive a 1099 or W-2 is not determinative.

Yes, there are unscrupulous people who try to file false workers' compensation claims, and if they are caught, they can be convicted of committing a felony. But what happens to companies who wrongfully and maliciously deny a claim or continually refuse to authorize the medical treatment an injured worker needs in order to recover from an injury and get back to work? Nothing criminal, and if the insurance carrier is found to have wrongfully withheld workers compensation checks, they have to pay a 15% penalty. This does not do anything to prevent the insurance carriers from doing this.
