Alabama Job Injury Lawyers Hurt in Car Accident while at Work: With the exception of Texas, the States in the United States generally force the majority of private businesses to carry workers' compensation insurance coverage for their employees. In Alabama, if a worker suffers a compensable job injury, their employers workers compensation insurance carrier must pay for (a) all of the workers' reasonably necessary medical treatment-for life, (b) reimburse the worker for mileage in driving back and forth for medical treatment or to receive medications; (c) pay the worker 2/3rds of their average weekly wage when off work pursuant to the advice of a physician treating them for their job injuries (until the date they reach maximum medical improvement) and (d) pay compensation to the injured worker for any permanent physical impairment sustained as a result of an on-the-job injury.

You will notice that an injured worker is not entitled to receive punitive damages, compensation for pain and suffering or other forms of compensation general tort law allows them to receive. Those other monetary damages are only available with personal injury claims. But what if your job related injury was caused by a third party who was not also an employee of your employer? What if, while performing your job duties, you are hurt in a car accident caused by the negligence of another person?

Is such a situation, the injured worker has two separate claims; one for workers compensation benefits, and another personal injury claim against the party whose negligence caused their injuries. Your workers compensation claim will enable you to receive the reasonably necessary medical treatment you need to recover from you injuries; you will also be entitled to temporary total disability benefits while you are off work recovering and for any permanent physical impairment you sustained as the result of your job injury.

You would also be entitled to receive compensation from the third party whose negligence caused your injury, including potential compensation for punitive damages, pain and suffering, and lost future earnings. However, employers' workers compensation insurance carrier is entitled to be reimbursed the money they paid during the course of your workers compensation claim. The mathematical formula used to calculate the amount of reimbursement the workers compensation insurance carrier is entitled to is somewhat confusing, and a mistake could be quite costly.
