Car Accident on the Job

Car Accident on the Job

Car Accident on the Job: Through the years, the Alabama Workers Compensation Lawyers at Powell and Denny have handled numerous job injury claims in which the job injury was suffered as a result of a car accident the worker suffered while performing their job duties. Many times the injured worker calls and asks if they are supposed to apply for workers compensation benefits in such a scenario. They aren't sure who is supposed to pay their medical bills-their own insurance, the negligent party's automotive liability carrier or workers' compensation. Even if your injury was the result of an automobile accident caused by the negligence of someone else, you should request workers' compensation benefits.

The reason is two-fold. First, if you were injured while performing your job duties, Alabama law dictates that your employer is to report your job injury, and at that point workers compensation is invoked. The second reason is so you can receive the medical treatment you need to get better and get back to work as soon as possible.

Under Alabama Workers Compensation Law, your employers workers comp insurance carrier has an obligation to pay all the reasonably necessary medical treatment you need, and our workers' compensation system is supposed to ensure that you receive all the reasonably necessary medical treatment you need in a timely fashion. The other driver's automotive liability carrier is under no such obligation and most liability or Uninsured/Under insured policies (UIM) simply do not carry enough in medical benefits to allow you to receive all the treatment you need.

Since your injuries were caused by another party, workers compensation will have a right to subrogation, which means that they will be allowed to recover the money they have spent in taking care of your needs from any recovery you receive from the other driver's liability insurance provider. Dealing with multiple insurance carriers-who have different obligations-can be tricky, and some of the more complicated cases we have handled as lawyers have arisen in these type of cases. The law on these cases has changed several times over the years and it makes them harder to address than the run of the mill car accident claim.

If you were involved in a car accident on the job, chances are good that you will be confronted with different questions and issues you are not sure how to handle. That is where an experienced Alabama Workers Compensation Lawyer and Personal Injury attorney comes in handy.

If you were injured in an automobile accident at work (even if it was your fault), and you have questions about how to proceed, please take the time to call and speak with one of the experienced attorneys at Powell and Denny today.
