Alabama Workers' Compensation Attorneys: What about Child Support? Unfortunately, divorce happens, and if children are involved, child support payments are part of the equation. What happens though if you were hurt at work and are not currently drawing your regular paycheck (ttd benefits are only 2/3rds of your average weekly wage)?

One thing will not automatically happen; your child support payments will not lower or be suspended unless you file a Motion with the Court which deals with your child support payments. Your child support obligations are ordered by the court and you are legally responsible for ensuring that they payments are made. The court will not know about the change in your income unless YOU inform them of this fact. In the past, we have gone to court with our injured clients to ask that our client's child support be reduced or suspended while our client is not working. If you inform the court of your circumstances, they are generally willing to help you.

If you are behind in the payment of child support benefits, then any settlement or award you receive as a result of your on the job injury is subject to being used to lower your deficiency.
