Alabama Social Security Disability Attorneys: What is a Case Review? Something we tell our Disability clients is that being awarded Social Security Disability benefits or SSI benefits does not necessarily mean that you will never be able to return to full time work. Yes, for some people, their disability is so severe that full time work will never be possible, but for many, the physical or mental condition which has led them to apply for disability benefits can abate, especially since they will be better situated to seek needed medical treatment once they have been awarded Medicare. We have helped many people obtain the disability benefits they need, only later to receive a phone call from a happily former disabled client explaining that they are now working again!

The Social Security Administration realizes this fact, which is why in certain cases the Administration will at times order that a person's disability claim be reviewed to determine if the person is still disabled; this is a Case Review.

If your condition is one which is reasonably expected to improve in time (such as after being injured in an accident which takes time to recover from), a case review may be ordered within 12-18 months. In other situations, depending on your age, your claim me be reviewed every 3-4 years. Even if the Administration does not believe your condition will sufficiently improve so as to allow you to return to full time employment, it is not uncommon for a case review to take place every 5 or so years (again, depending on your age).

Applying for disability does not mean you will never work again, just that for at least 12 months it is not feasible.
