Birmingham Workers Compensation Lawyers: Is the settlement offer fair? Over the years, our attorneys have talked with numerous injured workers who called after being offered a settlement by the workers' compensation insurance carrier; they want to know if the settlement offer being made is fair.

Sometimes this can be a difficult question to answer since we do not know all the facts, but we do try to review the injured worker's case with them to see if we can help. We review the facts, medical history, ask who the authorized treating physician is; ask whether the injured worker has availed themselves to their right to a panel of four, go over their average weekly wage, etc. We will always preface what we say by explaining that we are only going with what they have told us and that there may be other facts which would affect the value of their claim, but we do try to give them an idea whether the offer is reasonable with the facts provided. Sometimes the offer appears reasonable, but many times the offer being made ridiculous as the workers compensation insurance carrier will not explain all that you may be entitled to and will often try to trick the injured worker into giving up valuable rights for no compensation. In those situations, we try to explain what benefits the worker is entitled to, and at that time they generally decide to come in to discuss their claim in more detail. Personally, I have had situations where we were able to help the worker get thousands of dollars more in compensation, while protecting other valuable rights. Not long ago a client called after receiving an offer of $45,000; a few months later they settled for over $100,000.00 with future medical benefits open for life.

As a rule of thumb, one of the worst ways to evaluate the value of your claim is by having the insurance carrier tell you what it is worth.
