Claim for Workers Compensation Benefits Turned Down

Claim for Workers Compensation Benefits Turned Down: If you work in Alabama and were hurt on the job, you probably expect that workers compensation will do what the law states they have to do and that you will receive the economic and medical assistance to allow you to get better and return to work as soon as possible. If you are reading this blog though, chances are your claim was denied, and you are not alone as the insurance companies work hard to figure out ways in which to deny injured workers the benefits they are entitled to receive, and have come up with various and interesting ways in which to justify their denial of a workers compensation claim. Some may be valid, others are hogwash.

In out next few blogs we will be discussing some of the most common reasons I have seen as to why an injured workers' claim for workers compensation benefits are turned down: (1) You were not an employee; (2) Notice of a job injury was not made in a timely manner; (3) The injury was the fault of the worker; (4) The workers' disability is due to some pre-existing medical problem; (5) The worker was not "on the clock" at the time of the job injury; (6) The worker "failed" a post injury drug screen and (7) A utilization review physician has stated the injured worker does not really need the treatment recommended by the treating physician and therefore your medical treatment has been turned down.

It is our hope that these blogs and others we have written will answer your questions about your rights under Alabama's Workers Compensation laws, but if you desire additional information, please do not hesitate to request a FREE copy of our book "My Alabama Disability Claim (A Guide to Your Alabama Workers' Compensation and Social Security Claim)", or call and talk to one the experienced Alabama Workers Compensation Lawyers at Powell and Denny.
