Claim for Workers Compensation Benefits Turned Down

Claim for Workers Compensation Benefits Turned Down: If after suffering a job injury, the workers compensation insurance carrier accepted liability, you might think that getting the medical treatment necessary to help you get back to work would be rather easy and straight forward. It should be, but unfortunately in the last few years, getting the medical care you need so you can get back to work has been harder and harder, even when everyone agrees that you were injured at work.

The problem arises because the workers compensation insurance companies are allowed to second guess the doctor they told you that you have to see to receive medical treatment; this process is called a Utilization Review. It used to be that the only time a Utilization Review was used was when a particularly risky surgery was recommended, but these days we see it almost every time surgery is requested and often when a MRI or epidural block is requested.

In utilization review, the workers compensation insurance carrier sends some of your records to a doctor, whose services are paid for by the insurance carrier, in another State and then they ask this doctor whether the treatment ordered by the doctor who is actually treating you is really needed. Not surprisingly, quite often this doctor states that the recommended procedure is not medically needed. This decision is rarely, if ever, upheld by the courts, but workers comp will not back down absent a court order, which means a lawsuit and an appropriate motion will need to be filed. This is where an experienced Alabama workers compensation attorney is invaluable.
